REFUNDS & CANCELLATION POLICY

PROJECTS BY PEGGY offers an unconditional 30-day money-back guarantee on NEW HOSTING ACCOUNTS (does not apply to renewals). If the CLIENT wishes to cancel a NEW hosting account within the initial 30-day period for any reason, he/she has to notify Projects by Peggy, Inc. by U.S. Mail. Payment will be refunded within 30 business days.

DOMAIN NAME REGISTRATION FEES ARE NON-REFUNDABLE. Since all .com, .net, .org, .us, .biz and .info domains registered cannot be refunded, they will be subject to the $15.00 annual domain registration fee. As the CLIENT is the sole owner of the registered domain name, arrangements can be made to transfer its registration to another provider.

PROJECTS BY PEGGY does not offer any partial or prorated refunds on web hosting fees after the initial 30-day money-back guarantee period.

If a CLIENT disputes a setup/renewal charge for any account, Projects by Peggy, Inc. will not re-activate the service, unless the CLIENT covers all fees involved, including the chargeback fee and any other transaction fees.

ACCOUNT RENEWAL POLICY

PROJECTS BY PEGGY does not renew accounts automatically. For the CLIENT's convenience, PROJECTS BY PEGGY will send an invoice to the client’s email address on file approximately 30-45 days before expiration. The CLIENT is ultimately responsible for prepayment and renewal of the hosting account and domain registration. Projects by Peggy, Inc. assumes no responsibility if client email changes and notifications are not received. To ensure the receipt of renewal information and billing, please notify us if your email address changes.

DISPUTE RESOLUTION POLICY

In case of ownership dispute, Projects by Peggy, Inc. reserves the right to be the sole decision maker in settling the dispute. The following guidelines will be used to determine the rightful owner of the disputed hosting account or domain name:

• By default, ownership is granted to the person who paid for the hosting account.
• If the identity of the payee as discussed above cannot be confirmed, Projects by Peggy, Inc. will attempt to determine the owner in other ways, which include but are not limited to investigation of the content hosted under the respective hosting account or domain name, and investigation of the sequence of annual payments for the disputed service.
• Projects by Peggy, Inc. will consider a court decision overruling in case of ownership dispute, and will always comply with such a decision.

INDEMNIFICATION

CLIENT agrees that it shall defend, indemnify, save and hold PROJECTS harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees associated with PROJECTS’ development of the CLIENT’s web site. This includes Liabilities asserted against PROJECTS, its subcontractors, its agents, its CLIENTs, servants, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the CLIENT, its agents, employees or assigns.

CLIENT also agrees to defend, indemnify and hold harmless PROJECTS against Liabilities arising out of any injury to person or property caused by any products or services sold or otherwise distributed over the CLIENT’s web site. This includes infringing upon on the proprietary rights of a third party, copyright infringement, and delivering any defective product or misinformation which is detrimental to another person, organization, or business.

DISCLAIMER

Projects by Peggy, Inc., at its sole discretion, may change these terms and conditions at any time. By using PROJECTS BY PEGGY’s services the user agrees that Projects by Peggy, Inc. may (1) revise these terms and conditions; and (2) change the services provided.

Any such revision or change will be binding and effective immediately on posting of the revised terms or change to the service(s) on Projects by Peggy, Inc.’s web site, or on notification to the CLIENT by e-mail. The CLIENT agrees to review Projects by Peggy, Inc.’s web site, including these terms, periodically to be aware of any such revisions. If the CLIENT does not agree with any revision, he/she may terminate the services at any time by notifying Projects by Peggy, Inc. by e-mail. Notice of the CLIENT's termination will be effective on receipt and processing by Projects by Peggy, Inc.

The CLIENT agrees that, by continuing to use Projects by Peggy, Inc.’s services following notice of any revision to this Agreement or change in service(s), he/she abides by any such revisions or changes.

The content available through this site is the sole property of Projects by Peggy, Inc. and is protected by patent, copyright, trademark and other intellectual property laws. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate the content received through this site to anyone, including but not limited to others in the same company or organization without Projects by Peggy, Inc.’s express prior written consent.

REFUSAL OF SERVICE

Projects by Peggy, Inc. reserves the right at its sole discretion to refuse or cancel service. Lack of payment for services rendered, providing false personal information or violations of the Projects by Peggy, Inc. policies and terms could result in a warning, suspension, or account termination.

LIMITED LIABILITY

CLIENT agrees that any material submitted for publication will not contain anything leading to an abusive or unethical use of the Web Hosting Service, the Host Server or PROJECTS. Abusive and unethical materials and uses include, but are not limited to, pornography, obscenity, nudity, violations of privacy, computer viruses, harassment, any illegal activity, spamming advocacy of an illegal activity, and any infringement policy.

CLIENT hereby agrees to indemnify and hold harmless PROJECTS from any claim resulting from the CLIENT’s publication of material or use of those materials.

It is also understood that PROJECTS will not publish information over the Internet, which may be used by another party to harm another. PROJECTS will also not develop a pornography or otherwise unethical web site for the CLIENT. PROJECTS reserves the right to determine what is and is not unethical content.
